Estate of James Hogg, late of Durham, Farmer, deceased, Testate

Certified Copy of Will for the Registrar of Deeds

This is the last Will and Testament of me James Hogg of Durham in the County of Pictou, Farmer, made and executed the twenty second day of April in the year of Our Lord One Thousand Eight hundred and eighty three.
 
I give and bequeath to my Brother Robert Hogg, his heirs and assigns, that part of my real estate Situated on the west side of Roger's Hill Road, so called.

All the rest of my real estate I give and bequeath to my nephew James David McLellan his heirs and assigns.
The aforesaid bequests to the said James David McLellan and the said Robert Hogg are subject to the following conditions,

First - That the said James David McLellan, and the said Robert Hogg (words are subject to the following conditions are scratched out and initialed) shall each pay to my Sister in law, Jane Hogg the sum of ten dollars.

Second, That the said James David McLellan, and the said Robert Hogg, shall jointly erect a suitable monument over the remains of me, and my deceased wife Lillias Hogg.

I hereby nominate and appoint my nephew Robert McLellan Sole executor of this my last Will and Testament.

Signed  and executed by the testator as and for his last Will and Testament in the presence of us present at the same time, who in his presence and at his request and in the presence of each other have hereto Subscribed our names as witnesses this 22nd. day of April A.D. 1883.

I do hereby certify that the foregoing instrument consisting of one page & part of a page, is an exact and literal copy of the last Will and Testament of James Hogg late of Durham in the County of Pictou, Farmer, deceased, Testate, which has been duly filed and admitted to Probate in accordance with the practice of the Court.

Given under my hand at Pictou, this Second day of May A.D. 1883..
