Description
This indenture made this twenty seventh day of July in the year of our Lord one thousand eight hundred and fifty five between Robert S. Lowden of Merigomish in the County of Pictou Esquire and Elizabeth Lowden his wife of the one part and Dennis Dempsey of same place yeoman of the other part.
Whereas the said Robert S. Lowden and Dennis Dempsey being tenants in common of a certain lot of land containing one hundred acres situate in Merigomish aforesaid formerly owned by James Dempsey deceased did agree to refer the division of the same and all disputes in reference thereto the William H. Harris of Pictou and James McGregor of New Glasgow and such third person as they should choose to join the m, and they having appointed Peter Rofs of West Branch East River to join did in conjunction with the said Peter Rofs of and award the lot of land herein after described to the said Dennis Dempsey to be by him used and occupied in seventy, and did also set off and award to the said Robert S Lowden the remainder of said lot so owned by the said parties to be by him held used and occupied in seventy and whereas for the purpose of finally settling the will to the said portions so set off the said Robert S. Lowden and Dennis Dempsey have mutually agreed to execute each to the other a deed in fee simple of the portion so set off. Now therefore this indenture witnesseth that for and in consideration of the premises and of the sum of five shillings to the said Robert S. Lowden in hand paid by the said Dennis Dempsey at or before the sealing and delivery of these presents the receipt whereof is hereby acknowledging they the said Robert s. Lowden and Elizabeth Lowden his wife, Have and each of them Hath granted bargained sold aliened remises released and confirm unto the said Dennis Dempsey his heirs and assigns all that portion of the lot formerly owned by James Dempsey deceased as aforesaid which lies to the south of the main high way leading through the front settlement of Merigomish aforesaid and containing eighty acres more or less with all and singular the house building ways improvements and appurtenances hereto belonging or in any way appertaining and all the estate right title property interest claim and demand of them the said Robert S. Lowden and Elizabeth Lowden his wife or either at law or in equity in right of dower or otherwise howsoever. To have and to hold the same to him the said Dennis Dempsey and his Heirs and assigns forever. In witness whereof the said parties have hereto their hands and seals subscribed and set the day and year above written

Received on the day of the date of the foregoing indenture from the herein named Dennis Dempsey the sum of five Shillings being the consideration therein mentioned.
On this thirty first day of July A.D. 1853 personally appeared before me the subscriber one of her Majesties Justices of the peace for the county of Pictou Elizabeth U. Lowden party to the foregoing Deed and wife of Robert Lowden also party hereto who being by me examined separately and apart from her said Husband acknowledged that she of her own free will and accord and without any force or compulsion from her said husband signed sealed and executed said Deed for the purpose therein mentioned and contained.
